These Terms & Conditions ("Terms") form a legally binding agreement between you and the operator of FlashPan ("FlashPan", "we", "us", or "our") and govern your access to and use of the FlashPan mobile application, the website at flashpanapp.com, and any related services we provide (together, the "Service").
By creating an account, by tapping "I agree", or by using the Service, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, you must not use the Service.
These Terms contain important provisions that affect your legal rights, including limitations on our liability (Section 11), an assumption-of-risk acknowledgement for AI-generated content (Section 5), an indemnity (Section 12), and (where it applies to you) a binding-arbitration and class-action-waiver clause (Section 19). Please read them carefully.
1. What FlashPan does
FlashPan helps you discover recipes from the ingredients you have on hand. You can take or upload a photo of your ingredients and receive AI-generated recipe suggestions, ask the AI assistant follow-up questions, save recipes, manage a pantry and shopping list, and customise the suggestions with dietary preferences and (optionally) your country.
The AI features are powered by third-party large-language models (currently OpenAI). FlashPan is a consumer convenience tool — it is not a medical, dietetic, nutritional, food-safety, allergen-management, religious-dietary-certification, or emergency service.
2. Eligibility, accounts, and your responsibilities
To use FlashPan you must create an account using an email and password or sign in with Apple. You agree to provide accurate information and to keep your credentials secure. You are responsible for all activity that takes place under your account, and you must notify us promptly at mail@flashpanapp.com if you suspect any unauthorised use.
You must be at least 13 years old to use FlashPan. If you live in the European Union, European Economic Area, United Kingdom, or Switzerland and are under 16, or if you live in any other jurisdiction that sets a higher minimum age for digital services, you may only use FlashPan with the verifiable consent of a parent or legal guardian, and the higher local minimum age applies. If you are under the age of legal majority in your jurisdiction, you also represent that your parent or legal guardian has read and agreed to these Terms on your behalf.
You agree that you will not access or use the Service if you are located in a country subject to a U.S. Government embargo, or otherwise on any U.S. Government list of prohibited or restricted parties.
3. Tokens and in-app purchases
- Tokens are a consumable, non-monetary, virtual in-app credit used to unlock AI features (such as ingredient analysis, recipe generation, and AI chat). Different actions consume different amounts of tokens, and the exact number of tokens consumed by a given AI action may depend on the size of the request and response and on our pricing rules at the time of use.
- Tokens may be obtained by purchase through the App Store or Google Play, by promotional grants (for example, a daily reward you can claim once every 24 hours), or as discretionary credits we may issue from time to time.
- Tokens have no monetary value, are not legal tender, are not redeemable for cash or any other currency, are not transferable between accounts, cannot be combined with other accounts, and cannot be sold or assigned to anyone else.
- All token purchases are made through Apple or Google under their respective payment terms. We never see your payment-card details. We verify each purchase server-side before crediting tokens to your account, and we may refuse to credit any purchase that fails verification or that we believe was fraudulently or abusively obtained.
- Once a token has been consumed, the corresponding AI request is final and the token is non-refundable. Refunds for unused token purchases are handled exclusively under the refund policy of the App Store or Google Play, which you can request through them — we do not process payments directly and therefore cannot issue refunds ourselves. If Apple or Google refunds a purchase, we may revoke the corresponding tokens (or, if those tokens have already been spent, deduct the equivalent value from your balance, including taking it negative).
- We may change token prices, the number of tokens included in a package, or the number of tokens required for any feature at any time. Material changes that affect tokens you have already purchased will be communicated through the app or by email with reasonable prior notice.
- Promotional tokens (including the daily reward) are subject to these Terms, may be changed, suspended, or discontinued at any time, may have an expiry, and may be revoked if obtained through fraud or abuse — for example, mass account creation, automation of the daily-reward claim, account-sharing, or any attempt to circumvent the cooldown.
- EU/EEA/UK consumer right of withdrawal — important. Tokens are digital content. By purchasing tokens and using any of them, you expressly request immediate performance of the contract and acknowledge that, to the extent permitted by applicable law, you lose your statutory 14-day right of withdrawal for that purchase as soon as any token from it is consumed. This does not affect your refund rights under the App Store or Google Play policies, your statutory rights where the digital content is defective, or any other rights you have as a consumer that cannot be waived under your local law.
- You are responsible for any taxes that may be applicable to your purchases beyond those collected by Apple or Google.
4. Acceptable use
When you use FlashPan, you agree that you will not, and will not attempt to, and will not allow anyone else to:
- Use the Service for any unlawful purpose, in violation of any applicable law or regulation, or in any way that could damage, disable, overburden, or impair the Service or anyone else's use of it.
- Reverse-engineer, decompile, disassemble, modify, translate, copy, or create derivative works of the Service, except to the extent that applicable law expressly permits despite this restriction.
- Tamper with, bypass, or interfere with token balances, purchase verification, rate limits, authentication, account-deletion safeguards, or any other security or integrity feature of the Service.
- Use any automated means (bots, scripts, scrapers, headless browsers, emulators) to interact with the Service, to claim free tokens, or to consume AI features, except as we expressly permit.
- Mass-create accounts, share accounts, sell accounts, or use multiple accounts to circumvent rate limits, free-token cooldowns, or any other restriction.
- Submit content or images that are illegal, harmful, fraudulent, sexually explicit, that depict or sexualise minors, that infringe any intellectual-property, privacy, or publicity right, that defame or harass any person, that incite violence or discrimination, or that you do not have the right to submit.
- Use the Service to generate, request, or obtain content that would violate the usage policies of our AI provider (currently OpenAI), including content that constitutes child sexual abuse material, sexual content involving minors, targeted harassment, content promoting self-harm or terrorism, illegal advice, or attempts to extract personal data about identifiable individuals.
- Use prompt injection, jailbreak prompts, adversarial inputs, or any other technique to bypass the Service's safety guidance, dietary filters, or other guardrails, including attempts to cause the AI to recommend recipes or ingredients that you know to be unsafe for you or anyone you cook for.
- Use the Service to develop, train, fine-tune, evaluate, or benchmark a competing AI model or recipe-generation product, or to otherwise extract our prompts, system instructions, or model outputs in bulk for commercial use.
- Use the Service to provide commercial recipe-generation services to third parties, to operate a "wrapped" version of FlashPan, or to monetise FlashPan's outputs without our written permission.
- Misrepresent your identity, impersonate any person or entity, or claim a false affiliation with FlashPan.
We may investigate suspected violations and take action including warning you, throttling, suspending or terminating your account, revoking promotional tokens, and (where required by law or appropriate to protect our users) reporting the activity to relevant authorities.
5. AI-generated content, food safety, and assumption of risk
This section is critical and applies every time you use any AI feature of FlashPan. Please read it before relying on anything the app produces.
Recipes, ingredient detections, suggested substitutions, and chat responses produced by FlashPan are generated by AI models. AI models can be inaccurate, incomplete, biased, outdated, internally inconsistent, or wrong; they can hallucinate ingredients, quantities, cooking times, or safety advice; they can fail to recognise items in a photo or to flag dangerous combinations; and they can produce different outputs for the same input.
FlashPan is not a substitute for professional advice. Nothing produced by the app constitutes medical, nutritional, dietetic, allergen-management, food-safety, fitness, religious, legal, or other professional advice. If you have any condition or concern that requires professional guidance, consult a qualified professional — not FlashPan.
By using the AI features of FlashPan, you expressly acknowledge and agree that:
- Allergies, intolerances, religious and medical diets. Do not rely on FlashPan for any safety-critical dietary decision, including (without limitation) allergen-free, gluten-free, lactose-free, low-FODMAP, kosher, halal, vegan, vegetarian, diabetic, low-sodium, renal, or pregnancy-related diets. The dietary filters and preferences inside the app are best-effort hints to the AI and are not a guarantee. The AI may still output, or fail to flag, ingredients, substitutions, marinades, sauces, garnishes, brands, derivatives, additives, or cross-contamination paths that are unsafe for you. Always verify every ingredient, every packaged-food label, and every cooking step against your own needs and against authoritative sources before purchasing, preparing, or eating anything. If you, or anyone you cook for, has a serious allergy, medical condition, or other safety-critical requirement, consult a qualified professional and rely on official labelling — not on FlashPan.
- Ingredient recognition from photos. When you submit a photo for ingredient detection, the AI may misidentify items, miss items entirely, fail to detect allergens or contaminants that are not visible, confuse similar-looking ingredients, or invent items that are not present. Review and correct the detected list before relying on it.
- Food safety and storage. You are solely responsible for sourcing safe ingredients from reputable suppliers, for hygienic handling, for cold-chain and storage compliance, for cooking to safe internal temperatures, and for handling raw meat, eggs, fish, and other high-risk ingredients in a safe way. FlashPan does not verify any of these things and does not have visibility into the freshness, source, or condition of your ingredients.
- Substitutions and improvisation. Suggested substitutions may be unsuitable for your dietary needs, may significantly change the safety profile of a dish, or may produce unexpected results. Treat all substitutions as suggestions only and verify their suitability for you.
- Cooking-equipment differences. Cooking times, temperatures, and techniques produced by the AI assume conventional equipment and may not be safe or correct for pressure cookers, slow cookers, induction hobs, sous-vide setups, microwaves, or unfamiliar appliances. Adapt with care and consult the manufacturer's instructions.
- Assumption of risk. You use FlashPan's AI outputs entirely at your own risk, and you assume all risk of injury, illness, allergic reaction, anaphylaxis, food poisoning, intolerance, religious-dietary breach, adverse health effect, food waste, property damage, or other loss arising from your reliance on any AI output. This assumption of risk is a material part of these Terms — if you are not willing to accept it, you must not use FlashPan's AI features.
6. Your content, our licence, and your warranties
You retain ownership of the content you create or submit in the app — saved recipes, notes, pantry entries, favourite-ingredient lists, shopping lists, chat messages, and photos you submit ("Your Content"). You grant FlashPan a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, transmit, reproduce, adapt (for example, resize and re-encode photos), and display Your Content, and to transmit the parts necessary to fulfil your specific request to our AI provider, in each case solely for the purpose of operating, maintaining, securing, and improving the Service for you. We do not use Your Content to train AI models. Photos you submit for ingredient scanning are processed in transit and not stored by us, as described in the Privacy Policy.
By submitting any content to FlashPan you represent and warrant that: (a) you own Your Content or have all rights, licences, consents, and permissions necessary to submit it and to grant the licence above; (b) Your Content does not infringe or violate any third-party intellectual-property, privacy, publicity, contractual, moral, or other right; (c) Your Content does not contain illegal content or content prohibited by Section 4; and (d) your submission and our permitted use of Your Content will not violate any applicable law.
AI outputs. Subject to your compliance with these Terms, you may use the AI outputs the Service generates for you (recipes, ingredient detections, chat responses) for your own personal, non-commercial cooking. AI outputs are not necessarily unique to you and may be similar or identical to outputs generated for other users; we make no claim of ownership in them and grant no exclusive rights in them. We make no warranty that AI outputs are free of third-party rights — see Section 5 and Section 10. To the extent any AI output incorporates our prompts, system instructions, branding, or other proprietary material of FlashPan, those materials remain ours.
7. Availability, beta features, and changes
We aim to keep the Service available, but we do not guarantee uninterrupted, error-free, or secure operation. We may update, change, suspend, or discontinue the Service or any feature at any time, with or without notice, except where applicable law requires otherwise. Some features may be offered on a beta or experimental basis; they may behave unpredictably, may be removed at any time, and are provided "as is" without any warranty.
We may also update these Terms. Material changes will be communicated through the app or by email with reasonable prior notice. Continued use of the Service after the new version takes effect constitutes acceptance of it. If you do not accept a change, your remedy is to stop using the Service and (if you wish) delete your account.
8. Termination
You may stop using the Service at any time and may delete your account from within the app. We may suspend or terminate your access at any time, with or without notice, if (a) we believe you have breached these Terms or applicable law; (b) we are required to do so by law or by Apple or Google; (c) we believe your continued use poses a security, fraud, or abuse risk; or (d) we permanently discontinue the Service.
On termination, your right to use the Service ends immediately, your remaining token balance is forfeited (and is non-refundable, except where required by applicable law or by Apple or Google), and the data-deletion and retention rules described in our Privacy Policy apply. Sections 4 (Acceptable use), 5 (AI-generated content and assumption of risk), 6 (Your content and warranties), 9 (Disclaimers), 10 (Intellectual property), 11 (Limitation of liability), 12 (Indemnification), 14 (Third-party services), 17 (Governing law), 18 (Venue), 19 (Dispute resolution), and any other provision that by its nature should survive termination, will survive termination.
9. Disclaimers
The Service, including all AI features, is provided "as is" and "as available", with all faults and without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by applicable law, FlashPan and its operators, owners, employees, contractors, agents, licensors, suppliers, and service providers (together, the "FlashPan Parties") expressly disclaim all warranties, including any warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, security, freedom from viruses, uninterrupted availability, or quiet enjoyment.
Without limiting the foregoing, the FlashPan Parties make no warranty that any AI output is accurate, complete, current, safe, suitable for any particular person or purpose, or fit for any specific dietary, religious, medical, or other requirement. The FlashPan Parties do not warrant that the Service will meet your requirements, that any defect will be corrected, or that the Service will be free of unauthorised access.
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above disclaimers apply only to the maximum extent permitted by law, and your mandatory consumer rights remain unaffected.
10. Intellectual property
FlashPan, including its name, logo, branding, software, website, design, copy, prompts, system instructions, and any other materials we provide (other than Your Content and AI outputs), is owned by us or our licensors and is protected by copyright, trademark, trade-dress, and other intellectual-property laws. Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the Service for your own non-commercial purposes. No rights are granted to you except those expressly set out in these Terms; all other rights are reserved.
If you believe that material on the Service infringes a copyright, please send a notice that complies with the U.S. Digital Millennium Copyright Act (or the equivalent law in your country) to mail@flashpanapp.com. We may remove allegedly infringing material and terminate the accounts of repeat infringers in appropriate circumstances.
11. Limitation of liability
To the maximum extent permitted by applicable law, the FlashPan Parties will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to the Service or these Terms, including (without limitation) personal injury, illness, allergic reaction, anaphylaxis, food poisoning, religious-dietary breach, property damage, loss of data, loss of profits, loss of business, loss of goodwill, or loss of opportunity, whether based in contract, tort (including negligence), strict liability, statute, or any other legal theory, and whether or not the FlashPan Parties have been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, the FlashPan Parties' total aggregate liability for any and all claims arising out of or related to the Service or these Terms is limited to the greater of (a) the amount you paid us through Apple or Google in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) fifty euros (EUR 50).
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. In particular, for consumers in the European Union, European Economic Area, United Kingdom, or Switzerland, nothing in these Terms limits our liability for (i) death or personal injury caused by our negligence, (ii) fraud or fraudulent misrepresentation, (iii) gross negligence or wilful misconduct, or (iv) any other liability that applicable consumer-protection law does not permit to be excluded. For consumers in jurisdictions that do not permit the exclusion of implied warranties or the limitation of liability for certain damages, the disclaimers and limits in these Terms apply only to the maximum extent permitted by law. Where the cap above is held unenforceable for any particular claim, it will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
12. Indemnification
To the extent permitted by applicable law, and except where you are a consumer and the loss results from our breach, you agree to defend, indemnify, and hold harmless the FlashPan Parties from and against any third-party claim, demand, action, damage, loss, liability, cost, and expense (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms or of Section 4 (Acceptable use); (b) Your Content and the warranties you give about it under Section 6; (c) your violation of any applicable law or of the terms of any third-party service used through the Service (including Apple, Google, or OpenAI); (d) your intentional misuse of the AI features (for example, bypassing dietary filters or jailbreaking the assistant) and any harm you or anyone else suffers as a result; (e) your interaction with any third party in connection with the Service; or (f) your account being used by anyone other than you, where that use was reasonably preventable by you. We may, at our option, take exclusive control of the defence of any matter for which you are required to indemnify us; you must cooperate with that defence at your expense, and you must not settle any matter without our prior written consent. This clause does not require you to indemnify us for our own negligence or wilful misconduct, and it does not limit your mandatory consumer-protection rights.
13. Apple App Store and Google Play — additional terms
If you obtain FlashPan from Apple's App Store, the following additional terms apply, and they prevail over the rest of these Terms in the event of conflict:
- These Terms are concluded between you and FlashPan only — Apple is not a party to these Terms and is not responsible for the Service or its content.
- The licence granted to you in these Terms is limited to a non-transferable licence to use the Service on any Apple-branded products that you own or control and as permitted by Apple's Usage Rules in the Apple Media Services Terms and Conditions, except that the Service may be accessed by other accounts associated with you via Family Sharing.
- Apple has no obligation to provide any maintenance or support services in connection with the Service.
- If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Service. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service.
- FlashPan, not Apple, is responsible for addressing any claims by you or any third party relating to the Service or your possession or use of it, including (i) product-liability claims, (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer-protection or similar legislation.
- FlashPan, not Apple, is responsible for the investigation, defence, settlement, and discharge of any third-party claim that the Service or your possession and use of it infringes that third party's intellectual-property rights.
- You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms; upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
If you obtain FlashPan from Google Play, you acknowledge that Google Play's terms (including the Google Play Terms of Service) apply to your acquisition and use of FlashPan, and that, as between you and us, Google has no responsibility for the Service.
14. Third-party services
FlashPan relies on third-party services including Supabase (backend hosting, authentication, database, edge functions), Apple App Store and Google Play (distribution and payments), Apple (Sign in with Apple, where used), and OpenAI (AI model provider). Your use of the Service is also subject to the terms and policies of these providers where applicable. Their availability and behaviour are outside our control. We may change service providers in the future; if we do, we will update our Privacy Policy accordingly.
15. Feedback
If you send us suggestions, ideas, or feedback about the Service, you agree that we may use them without restriction or compensation. Your feedback is provided on a non-confidential and non-proprietary basis. This does not grant us any rights in your personal data beyond what is set out in the Privacy Policy.
16. Force majeure and third-party outages
We are not liable for any delay, unavailability, or failure to perform caused by events beyond our reasonable control, including natural disasters, war, civil unrest, acts of government, strikes, internet or telecommunications failures, cyber-attacks, security incidents at third-party providers, or outages, failures, or changes of terms by any of our third-party service providers (in particular Apple, Google, Supabase, or OpenAI). If such an event prevents you from using AI features for which you have spent tokens, our sole responsibility is, where technically feasible, to pause token consumption or to credit back tokens consumed during the outage; this is your sole and exclusive remedy for availability issues caused by such events, except to the extent applicable law requires otherwise.
17. Governing law
These Terms, and any non-contractual obligations arising out of or in connection with them, are governed by the laws of Hungary, excluding its conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer-protection laws of the country in which you have your habitual residence.
18. Venue (non-arbitration matters)
Subject to Section 19 (Dispute resolution), and except where applicable law gives you, as a consumer, the right to bring proceedings in another forum, the courts of Hungary have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service. If you are a consumer in the EU, you may also use the European Commission's online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not, however, obliged to participate in alternative dispute resolution before a consumer arbitration board.
19. Dispute resolution and arbitration (United States residents only)
This Section 19 applies only if you are a resident of the United States. If you are not a U.S. resident, this Section does not apply to you and you should rely on Section 17 and Section 18 instead.
Informal dispute resolution. Before filing any claim, you agree to try to resolve it informally by emailing mail@flashpanapp.com with a description of the dispute and your contact details. We will try to resolve it within 60 days. If we cannot, either of us may proceed under the rest of this Section 19.
Binding arbitration. You and FlashPan agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms (a "Dispute") that is not resolved informally will be resolved exclusively by final and binding arbitration administered by a reputable arbitration provider (such as the American Arbitration Association under its Consumer Arbitration Rules) on an individual basis, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this clause. The arbitration will take place by videoconference or, if you elect, in your county of residence; the arbitrator's decision will be final and may be entered as a judgment in any court of competent jurisdiction.
Class-action waiver. You and FlashPan agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
Exceptions. Either party may bring an individual action in small-claims court for disputes within that court's jurisdiction. Either party may also seek injunctive or other equitable relief in court for actual or threatened infringement, misappropriation, or violation of intellectual-property rights.
Right to opt out. You may opt out of this arbitration agreement by sending us written notice at mail@flashpanapp.com within 30 days after first accepting these Terms. The notice must include your name, your account email, and a clear statement that you wish to opt out of the arbitration agreement. Opting out will not affect any other part of these Terms.
If any portion of this Section 19 is found unenforceable, that portion will be severed and the remainder will continue to apply, except that if the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will be severed from the arbitration and proceed in court.
20. Severability and assignment
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign or transfer these Terms or any of your rights under them without our prior written consent; we may assign these Terms in connection with a merger, acquisition, restructuring, or sale of all or a portion of our assets.
21. Entire agreement
These Terms, together with the Privacy Policy and any in-app acknowledgements you accept (including the AI-feature acknowledgements), constitute the entire agreement between you and FlashPan regarding the Service and supersede any prior or contemporaneous agreement, understanding, or communication between you and FlashPan on the subject.
